LAND SALES.

Mr. J. F. Milstead has purchased at public sale, in the chancery suit of Milstead against Milstead, a tract of land near Minneville, Prince William county, containing 199 acres, for $2 per acre.

The Hutchinson tract, near Hickory Grove, in the same county, containing 186 acres has been sold to Mr. Henry Lynn for $8 per acre.

This Indenture made and entered into this 3rd day of February 1834 between Hendley Milstead of the first part, John C. Weedon of the second & Howison Hooe of the third part. Whereas the said Milstead is justly indebted to the sd. Hooe in the sum of Two Hundred & forty dollars & eighty seven & half cents as by bond bearing date the 4th day of November 1833 more fully appeared which bond with legal interest accruing thereon, he the said Milstead is willing & desirous to secure. Now then this Indenture witnesseth that the said Hendley Milstead for and in consideration of the promises as also for the further sum of One dollar in hand paid by the said Weedon to the said Milstead at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the said Milstead has bargained, sold, aliened & conveyed and by these presents doth bargain, sell, alien & convey unto the said Weedon his Exr. admr. vc a certain negro boy named Henry, to have and to hold the said boy unto him the said Weedon his Extr. admr. forever.

Upon trust nevertheless & to & for the following purposes, that is to say, The said Weedon is to permit the said Milstead to remain in peaceable possession of said Slave and appropriate the proceeds of his labor to his own  use until default in payment of said note which by agreement between the parties is fixed to the first to the first of April 1834 and then on this further trust that if the aforesaid Milstead shall fail to pay on or before the first of April the amount the aforesaid bond with the legal Interest accruing thereon, then and in that event the aforesaid Weedon shall sell as soon as thereafter as he may think proper or the said Hooe or his representatives may direct at public auction to the highest bidder for cash at Brentsville the said boy, having given at least fifteen days notice of such sale by advertisement to be set up at Brentsville and such other public places in the county as said Weedon may think proper and out of the proceeds of such sale the said Weedon shall pay over to the said Hooe his Exr. adr. or assigns the amount of the aforesaid note with the legal interest accruing thereon, and the balance of any there be the said Weedon shall pay over to the said Milstead his Exr. & admr. vc. but if the said note shall be paid off when the same is due so that there is no default in the payment thereof, then the above obligation to be void, or else to remain in full force & virtue. In testimony whereof the parties have hereunto set their hands & seals the day & date fixed above written.

Happy New Year to All

Miss Florella Milstead of Washington is spending the holidays with her parents, Mr. and Mrs. J. Frank Milstead.

Mr. E. M. Garner spent Sunday with Miss Eva Kidwell, of Agnewville.

Mrs. Edith Yates of Washington is spending the holidays with her mother, Mrs Annie Garner and her daughter, Alma Yates, who has been with her grandmother for some time.

Mr. and Mrs. Raymond Sprague of Washington are visiting relatives here.

Dr. W. Fewell Merchant of Manassas was in this vicinity several days last week looking after smallpox patients and vaccinating.

Mr. and Mrs. Tyson Reid and daughter, Miss Maxine, were in Washington shopping Saturday.

A horse belonging to Mr. Daniel Reid was kicked by another horse last Friday night.  Mr. Reid's animal suffered a broken leg and had to be killed.

This deed made the 17 day of September 1915, between G. W. Hixson, party of the first part, and Frank Milstead party of the second part,

WITNESSETH: That for and in consideration of its value cash in hand paid by the said second party to the said first party, the receipt whereof is hereby acknowledged, the said party of the first part doth by these presents bargain, grant, sell, release, convey and confirm unto the said party of the second part, with general warranty of title west half of lot Number 47, as designated in the plat and survey of West End Cemetery, adjacent to the town of Manassas, in the county of Prince William, the same to be used as a burial place for white persons only.

Witness the following signature and seal.

I, L. M. Jones, a notary public for the county aforesaid, in the State of Virginia, whose commission expires on the 12 day of August, 1916, do certify that G. W. Hixson, whose name is signed to the foregoing deed, bearing date on the 17 day of September, 1915, hath acknowledged the same before me in my county aforesaid.

Amanuensis Monday: Agreement between Milstead and Ives

2 February 1856

Whereas a difficulty having arisen in relation to the boundary lines between the respective lands of Isaac Milstead and Reubin Ives in the County of Pr. William & state of Virginia and the said Milstead and Ives being desirous to settle and adjust the same want this present writing witnesseth that for divers good causes for and in consideration of the object intent & purposes herein before mentioned, the said Milstead and Ives have mutually agreed to and with each other after having had their respective lines surveyed to fix and establish forever the following boundary lines between their lands aforesaid.  

Beginning at a small white oak on the west side of a road thence N 35°  11 poles to some stone sin a large hollow stump & several distant marked pointers thence N 13° 50 uc 73 ½ poles to an old marked Spanish oak now dead on the east side of said road  corner to said Milsteads thence N 1.47 & 66 ½ poles to a white oak marked on the west side of said raid a corner to said Milsteads and Ives and the land of Mer. John Finch and it is further covenanted, stipulated & agreed between the said Milstead and Ives that hereafter should either of them or their heirs or any person or persons acting through or by their consent, will and liberty of the said Milstead or Ives, in disregard of the agreement and contrary to the intents & purposes herein before mentioned, commit any manner of trespass upon the land beyond the line or lines above described & established by claiming title to and taking possession thereof or enter suit in law to recover the same, the party upon whose tract such trespass shall have been made or suit entered as aforesaid shall forfit and pay to the advised party or his heirs the sum of one hundred dollars.  Witness whereof the said parties have hereunto interchangeable set their hands & affixed their seals this the first day of August in the year of our lord one thousand eight hundred & fifty three.

This Indenture made this 4th day of March 1834 between Thomas Able and Francis his wife of the one part of the County of Fauquier & State of Virginia and Henry Milstead of the county of Prince William & State of Virginia of the other part.  Witnesseth that the said Thomas Able & Francis his wife for and in consideration of the sum of Sixty dollars to them by the said Henry Milstead in hand paid the receipt whereof is hereby acknowledged hath bargained, granted, sold & conveyed and by these presents do bargain grant sell & convey unto the said Henry Milstead, his heirs and assigns a lot of land containing thirty nine & half acres a part of Racoon Hill farm near the Town of Dumfries to have & to hold the said lot of land with all the appurtenances thereunto belonging to him the said Henry Milstead his heirs & assigns to the only proper use and behoof of the said Henry Milstead his heirs and assigns forever. And the said Thomas Able & Francis his wife for themselves their heris executor & administrator do hereby covenant and agree to and with the Henry Milstead his heirs & assigns that the said Thomas Able & Francis his wife & their heirs that the said lot of ground with its appurtenances unto him the said Henry Milstead his heirs & assigns against against [sic] them the said Thomas Able & Francis his wife and their heirs and against all persons whomsoever shall & will by these presents forever warrant & defend. In witness whereof the said Thomas Able & Francis his wife have hereunto set their hands and affixed their seals the day & year above written.

Weems justices of the peace in the county aforesaid in the State of Virginia do hereby certify that Thomas Able party to the above deed bearing date on the 4th day of March 1834 personally appeared before us in our county aforesaid & acknowledged the same to be his act and deed and desired us to certify the said acknowledgement to the Clerk of the county court of Prince William in order that the said deed might be recorded. Given under our hand & seals this 4th day of March 1834.

     We John W. Williams & Jesse E. Weems justices of the peace in the county aforesaid in the State of Virginia do hereby certify that Francis Able parties to a certain deed bearing date the 4th day of March 1834 personally appeared before us in our county & being before us privately and apart from her husband having the deed aforesaid fully explained to her she the said Francis acknowledged the same to be her act and deed and declared that she had willingly signed, sealed & delivered the same and wished not to retract it. Given under our hand & seals this 4th day of March 1834.

Wedding Wednesday: Mary Margurite Milstead to Earl Vance Fisher

ALEXANDRA, VA., December 28. -- Miss Mary Margurite Milstead, daughter of Mr. and Mrs. John H. Milstead, and Earl Vance Fisher, of Washington, were married at high noon to-day at the home of the bride's parents, 1001 King Street, by Rev. P. P. Phillips, rector of St. Paul's Episocopal Church.  Afterward they for a Northern bridal trip, and upon their return will reside in Mobile, Ala., where the groom is engaged in business.

Sunday's Obituary: John H. Milstead

October 30, 1913

John H. Milstead, seventy-one years old, a former resident of this city, died this morning at his home in Washington.  The body was brought here this afternoon and taken to the home of his son-in-law, J. Edward Shinn, 26 South Royal Street, where the funeral will be held at 1 o'clock Friday afternoon.  Services will be conducted by the Rev. R. P. Phillips, rector of St. Paul's Episcopal Church.

Mr. Milstead was a native of Occoquan, Prince William County, Va., and had lived forty years in Alexandria.  At the time of his death he was an engineer at the laboratory at Benning.

 Besides his wife Mr. Milstead leaves the following children:  John, Bruce, Wilton, and Mahlon Milstead, Mrs. J. Edward Shinn, Mrs. Grace Talbot, and Mrs. Marguerite Fisher.

Sunday's Obituary: William Milstead

WILLIAM MILSTEAD. Laurel, MD. April 5 – The funeral of Mr. William Milstead was held this afternoon at the Laurel Presbyterian Church, Rev. A. E. Baker officiating.

Mr. Milstead was a native of Occoquan, Va., and was born in the year 1834. His wife was a Miss Mary J. Macartney, of Cecil county, Maryland. He made Laurel his place of residence for about 30 years. For 20 years he conducted the Milstead Hotel, which structure was destroyed by fire several years ago. He was affiliated with Laurel Wreath Lodge of Masons, the local commandery of the Knights of Pythias and with the Order of Odd Fellows. The services at the grave were conducted by Laurel Wreath Lodge and the pallbearers were Masons and Knights of Pythias. The funeral was largely attended, among those present being ex-Congressman Blakeney and Mayor Timanus.

Mr. Milstead was one of Laurel's most prominent and esteemed citizens and died April 3 at the Maryland University Hospital, of Baltimore, where he had been taken for treatment after an illness of less than a week. Mrs. Mary J. Milstead and three sons and four daughters survive him. The children are Mr. John H. Milstead, Mrs. W. C. Beall, Mr. William P. Burns, all of Baltimore; Mr. William T. Milstead, of Washington; Mrs. A. M. Kellogg and Mrs. D. C. Fithian, of Laurel, and Mr. Walter A. Milstead, of Manila, P.I.

Jane Cole is my 3rd great-grandmother.  She married Lawrence Cole, a prominent landowner in Independent Hill, sometime before 1835.  I have yet to find the details of their marriage and am uncertain of her maiden name, but she is listed as "Jane Milstead" on the death record of her son, James Lawrence Cole, who died in Prince William County in 1914.

Jane (Milstead?) Cole is buried in the family cemetery beside her husband on Joplin Road in Independent Hill, VA.
