Will: Robert Luttrell (1819)

In the name of God Amen. I Robert Luttrell of Prince William County and Commonwealth of Virginia being in my perfect sences do make and ordain this my last will & testament in manner and form following to wit.

Impromis I give and bequeath to my wife Nancy Luttrell for & during her natural life the use of one sixth of my slaves the one sixth of all my stock all my household & kitchen furniture with the use of my mantion house and two hundred acres of land thereunto adjoining part of which land was formerly the property of Phillimon Waters and after the death of my said wife I give and devise the affoursaid land to my two sons Simon & Thomas to be equally divided between them and the slaves devised to my wife after her death to be equally divided between my three daughters Melenday Jane and Peggy for them and their heirs forever.

Item I give and bequeath unto my son Simon Luttrell and his heirs forever the plantation that Benson Lynn lives on containing 166 acres and 426 1/2 acres of land adjoining the lands of Misses Tebbs and John McMillian. The one sixth pat of my slaves the one sixth part of all my stock except the horses and there is to be four hundred & seventy dollars deducted out of his part.

Item I give and bequeath unto my son Thomas Luttrell and to his heirs forever five hundred and ninety two & a half actes of land the one sixth part of my slaves & the one sixth part of all my stock but in case my land shall contain more than 1385 acres what is over is to be equally divided between my tow sons Simon and Thomas.

Item.  I give and bequeath unto my daughter Melenday Davis and to her heirs forever one sixth part of my slaves, the one sixth part of my stock.

Item I give and bequeath unto my daughter Jane Luttrell and to heirs forever the one sixth part of my slaves, the one sixth part of all my stock and one hundred dollars, one bed & furniture bedstead & desk.

Item. I give and bequeath unto my daughter Peggy Luttrell and to her heirs forever the one sixth part of my slave, the one sixth part of all my stock and one hundred dollars one bed bedstead & furniture for said bed one desk a saddle & bridle.

All my property that is not mentioned in this will is to be equally divided betw[e]en my wife and children. My wife is to be furnished with a sufficient quantity of pork corn & c. to last her and her family twelve months after my death.  It is my wish that my son Thomas Luttrell is sent to school five years his schooling & bord to be paid out of my estate. Lastly I do hereby constitute and appoint my son Simon Luttrell & John F. Davis to be the Executors of this my last will and testament hereby revoking every other will and testament by me heretofore made.

In witness whereof I have hereunto set my hand and affixed my seal this 2nd day of April in the year 1812.

At a Court of Quarterly Sessions held for Prince William County March 1st 1819. This last will and testament of Robert Luttrell dec. was presented to the Court by the oaths of Wm. F. Moore Bernard Botts and Thomas Chapman is ordered to be recorded and the said Simon Luttrell having made oath to the same according to Law and taken the oath of an Exor. and performed what is usual in such cases certificate is granted him for obtaining a probate thereof in due form.

Will: Jane Keough (1823)

In the name of God Amen I JANE KEOUGH of the County of Prince William & State of Virginia do make this my last will and testament in maner and form as follows.  First, I give and bequeath unto my son MATHEW KEOUGH and to his heirs forever the land I now live on which said land I purchased from Baylis Renoe for one hundred and forty acres be the same more or less and the further sum of four hundred dollars which said legacy is on account of money he has furnished me.  Secondly, I give and bequeath unto my seven children namely MATHEW KEOUGH, PATRICK KEOUGH, JOHN KEOUGH, WILLIAM KEOUGH, CHARLES KEOUGH, HARRIET KEOUGH and MARGARET KEOUGH all the residue of my property to be equally divided between them with this proviso that my son WILLIAM KEOUGH shall not dispose of any part of his property without the consent of my Executor & Executrix.  Thirdly, in case my son MATHEW KEOUGH should depart this life before myself the property I have bequeathed him I bequeath unto my two daughters HARRIET KEOUGH and MARGARET KEOUGH to them and their heirs forever.  Fourthly and lastly I do hereby constitute and appoint my son MATHEW KEOUGH and daughter HARRIET KEOUGH Executor and Executrix of this my last will and testament revoking all others heretofore by me made in witness whereof I have hereto set my hand & seal this 13th day of January eighteen hundred and twenty one.

Deed: James Keys to Benson Lynn (1827)

THIS INDENTURE made this first day of September in the year of Our Lord One thousand eight hundred and twenty seven between JAMES KEYS of the County of Prince William and state of Virginia of the first part and BENSON LYNN of the same County and State of the second part and SIMON LUTTRELL of the aforesaid County and State of the third part; Witnesseth that whareas the said JAMES KEYS is justly indebted to the said SIMON LUTTRELL in the sum of seventy four dollars sixteen cents to be paid on demand as by a bond bearing date the 31st day of August 1827 more fully appears which debt the said JAMES KEYS is willing and desireous to secure. Now this Indenture witnesseth that for and in consideration of the premises and also for the further consideration of one dollar lawful money of Virginia to the said JAMES KEYS in hand paid by the said BENSON LYNN at and before the sealing and delivery of these presents the receipt whareof is hereby acknowledged he the said JAMES KEYS hath given granted bargained and sold and by these presents doth give grant bargain and sell to the said BENSON LYNN his heirs executors Administrators and assigns the following property. Viz. One hor(s)e, one mare, two cows, two yearlings eight hogs, two beds & furniture all the crop of corn & fodder growing on the land and all the right title and interest of the said JAMES KEYS in and to the said property. To have and to hold the aforesaid property until the said BENSON LYNN his heirs executors and administrators or assigns forever. In trust never the less for the uses and purposes herein after mentioned and for none other that is to say if the said JAMES KEYS his heirs executors or administrators shall well and truly pay or cause to be paid the said sum of seventy four dollars sixteen cents with such interest as may be due on the same on or before the 10 day of the present month (September) then the said BENSON LYNN his executors or administrators is to reconvey such right title and interest in and to the said property to the said JAMES KEYS his heirs or assigns at the proper costs and charges of him the said JAMES KEYS his heirs executors administrators or assigns. But upon the failour of the said JAMES KEYS his heirs executors administrators or assigns to pay or cause to be paid to the said SIMON LUTTRELL his certain attorney his executors administrators or assigns the said sum of seventy four dollars sixteen cents with whatever interest may be due on the same then it shall be competent for the said BENSON LYNN his executors or administrators upon giving twenty day notice of the time and place of the sale to sell at public auction for cash to the highest bidder the whole or so much of the said property here by conveyed or intended to be conveyed as will be sufficient to rase the said sum of seventy four dollars sixteen cents & the costs attending the sale thereof the notice to be given at the front door of the Court House of Prince William County and some other public place in said County and after paying and dischargeing all the costs and charges necessary to carry the provisions of this Indenture into effect shall pay and satisfy to the said SIMON LUTTRELL the said sum of seventy four dollars and seventeen cents. In testimony whareof we have hereunto set our hands and seals this day and year first in the premises writen.

At a Court held for Prince William County September 3d. 1827. This Indenture between JAMES KEYS of the 1st part BENSON LYNN of the 2d. part & SIMON LUTTRELL of the 3d. part was acknowledged by the parties thereto to be their act & deed & admitted to record.
